For Values to produce higher Productivity and instill Creativity while upholding highest possible and attainable Quality in the process, the Values need to thrive in the air of honesty. </P><P>Honesty in a company is synonym for courage and is a measure of risk readiness and agility. I define the Fuel Index as one that measures the sustainability and agility of a company. Unfortunately, the already fortunate usually prosper and the unfortunate suffer. Such is the case of a single mom in business, producer of the highly successful BET/NFLPA party. The NFL Players Association-Houston Chapter wrote bad checks amounting to over $31,000 to the producer of the much-publicized BET/NFL Players Super Bowl gala held at the Galleria Pavilion last year. </P><P>The event featured athletic greats, and attracted over 8,500 patrons in one evening. According to a witness, "they carried off boxes of cash to be counted." The NFLPA first agreed to a fixed price of $60,000, which was changed at the last minute, and cost the producer penalties of over $6,500. Then the NFLPA persuaded the woman to move forward by promising to "wire money" to her bank account. Instead, the NFLPA deposited checks--worthless checks. When they were dishonored, the woman's banker received a call from NFLPA V.P. </P><P>Charles Taylor, Jr., who stated, "Billy Burge will cover the checks" (Mr. Burge is the Chairman of the Harris County-Houston Sports Authority).  Convinced by Taylor's statement, the bank re-submitted the checks for collection. The checks were returned again. By that time, the BET/NFLPA show was over and the money had vanished. </P><P>The woman was not aware of the payments being in the form of checks until the gala was over.She has filed a complaint with the District Attorney's office, which said, "it does not fit the Texas Penal Code." She has also filed a civil lawsuit--Cause No. 819789, in the County Civil Court at Law No. One of Harris County, Texas. The NFLPA claims Taylor was not authorized to sponsor the party and is not willing to offer any restitution. Conversely, Taylor does not dispute the money is owed. </P><P>Unless a settlement is reached, the civil courts will decide.The feeding frenzy is now in Jacksonville?are they prepared for the same fall-out?. </P>]]></content:encoded>

		<content:encoded><![CDATA[<P>Every year nearly 60,000 airplanes take off and land with an estimated 36 billion paper checks at an annual processing cost of $8 billion. Who pays this $8 billion dollars? The banks and credit unions across the nation, that's who. Why do they go to all this effort and expense? Many state commercial codes stipulated that only a canceled check was proof positive of payment. Since there are nearly 18,000 financial institutions in the United States, most of them have not been able to charge fees to cover this $8 billion cost of letting you have a checking account. This means that all of that money has to come out of other fees, penalties and loan rates. </P><P> At least this was the truth until October 21, 2004 when a new federal law took effect trumping states rights to regulate banks within their borders. The Check 21 Act allows a paper preprint of a check to be considered the equivalent of the original check. In English this means a bank in Oregon can copy a deposited check, send the image to your bank via electronic means and receive their money all in the same day.  Image exchange checks will not replace the old fashioned method of moving paper checks any time soon, though the number of checks written a year is decreasing an estimated 5%. Analysts expect the image exchange checks to surpass paper processing in 2006. </P><P>So why do banks want to invest in the equipment and security measures necessary to move checks electronically when the other method works? I can name you 5 reasons for every check every financial institution handles and they are all named Lincoln. Every check a bank does not handle is a savings of 5 cents, for an annual average savings, per bank, per year, of $266,000. How will this affect you, the consumer, who writes 120 checks a year for every man, woman, and child in this country? It doesn't affect you very much, except you will likely be receiving a printout of your checks with every statement.  The exception to this is if you are one of the millions of consumers who will write a check on Thursday, the day before your paycheck is deposited. You have become accustomed to writing a check and having a couple days to get the money into the account before the check reaches your bank. </P><P>You are using what is called the float principle. Simply put, the float principle is the amount of time it takes a check to be deposited, trucked and flown to your bank.  With image exchange, the float is sunk. Through 2006 the banks and credit unions can collect an estimated $170 million per month in bounced check fees on nearly 7 million checks written on accounts before the money was in the account.  That $170 million translates into 5 cents for every check written in the nation, or nearly $266,000 per bank, per year. </P><P>This money will be taken from consumers in the form of "service fees", turning that $35 check into a $70 check because of the $35 bounced check service fee. Who is more likely to have insufficient funds in their checking account - the above average income or the below average income consumers?  I guess it depends on your definition of below average income. The ultra-below make less than $10,000 a year and mostly operate without checking accounts. The ultra-above make more than $250,000 and use electronic or plastic means of paying for their purchases and everyday expenses. That leaves the rest of the nation, approximately 200,000,000 of us to provide enough service fees for the banks to average a quarter million dollars in unearned income each year. </P><P>We're the people writing 10 checks every month for every member of our household. We're the busy parents of active children trying to do everything and be everything in what we call an American dream. How can you protect yourself and keep from adding to your banks bottom line? Control your checkbook and perhaps even change your spending habits. As more and more banks switch to the Check 21 system, you have to be ready for when it happens to you.  You can do this in a very simple, practical, and easy manner. </P><P>Flip-flop the order of writing checks. Let me demonstrate on Sue, a typical mother of two children (12 & 14) who works at a local office building. Every Friday her weekly paycheck is deposited in her checking account electronically.  How Sue will respond to Check 21 is that from now on she will no longer do the grocery shopping on Thursday after soccer practice. Instead she will wait until Saturday after gymnastics, or even Monday on her way home from work to swing by the store and pickup a couple bags groceries for the week. </P><P>By making this switch in routine, she will know the money for the groceries is in the bank.  Now let's make the assumption that instead of some imaginary woman named Sue, this person was you. Did you see what happened? Instead of writing a check before the money was in your account, you waited to write the check after the money was in available. This guaranteed your check would clear and you would not be charged any unexpected service fees. By waiting to write checks until after the funds are in the account will take a little practice on your part and might be more difficult to do than it sounds. </P><P>If you make the effort, and train yourself to think like a banker so you can avoid service fees, you will come out money ahead.  As the rules of banking change, you have to know and understand your rights and what these rule changes mean to you. Check 21 legislation was enacted to make check processing easier and more convenient for financial institutions across the country. They are also anticipating a surge in income through service fees. It's only 2 cards of a 7 card equation. In nearly every situation, you want to come out firing with A-K as your hole cards. (The exception would be when faced with a big raise from an early position bettor.) When the flop comes, you need to reassess your hand and think things through before you just assume your overcards are best.Like many other situations in Texas Holdem, knowing your opponents will help you gauge your situation when you hold A-K and see a flop like 9-8-2. </P><P>Since you bet preflop and were called, you assume your opponent is also holding good cards and the flop may have missed them as badly as it missed you. Your assumption will often times be correct, but they could be holding a pocket pair and be leading in the hand, or worse yet have pocket 9s, 8s, or 2s. Also, don't forget that many poor players wouldn't know good cards if they tripped over them and could have called with A-x and paired the board.If your opponent checks, you could check and see a free card or make a bet and try to pick the pot up right there. If they bet, you could raise to see if they are for real or fold. What you want to avoid is simply calling your opponent's bet to see what the turn brings. </P><P>If any card other than and Ace or King hits, you won't know any more information than you did after the flop. Let's say the turn brings a 4 and your opponent bets again, what do you do? To call a bet on the flop you had to think your hand was the best, so you must surely think it still is. So, you call a bet on the turn and one more on the river to find out that your opponent was holding 10-8 and only had second pair after the flop. At that point, it dawns on you that a raise after the flop could have won the pot right then. Instead, you called and lost 3 more bets in the hopes of catching a miracle card or that your Ace high would hold up. </P><P>If you would have raised on the flop and been called or reraised it would have only cost you 2 bets to learn more about the strength of your opponents hand.Ace-King is a beautiful thing to see in your hole cards. Just be sure you play them wisely and they can bring you great happiness at the poker table. 		<content:encoded><![CDATA[<P>We have all heard in recent years that the need for a substantive policy of conducting pre-and post-employment background checks exists in more than just defense contractor and fiduciary-based enterprises. Today, with the overwhelming preponderance of employer liability litigation, and with negligent hiring being the focal point of round-table discussions of some of the plaintiff's firms, the need for thorough background checks has been substantiated. This is a common sense perspective, not only from the standpoint of getting the best possible people for the job, but also to protect a company form this type of litigation.In 1979, our company set out to learn how to not only provide the best possible background checks, but also to determine just where "factual employment screening" would fall in the scheme of things. To understand why "screening" is where it is today, one needs a little history of the subject. In the beginning, screening usually started with the security department. </P><P>These were typically highly qualified, deeply motivated, wholly energetic, recently retired law enforcement professionals who were completely inundated. After being given the entire responsibility for the safety and security of the company, its executives and their families, they were given the task of qualifying those who would pass through the gates each day as employees. Since these individuals were for the most part "old boys," they sometimes used, in today's politically correct terminology, "improper" methods of "checking out" the applicants. This responsibility typically stayed in the security department until about the late 1970s, when what are now called human resources departments saw the need to get in the loop for what was to become "employment screening." Needless to say, those "improper" methods referred to have all but disappeared in smart companies. However, due to the lack of knowledge of some human resource personnel when it comes to things like criminal records, credit reports, and driving histories, some have fallen prey to those who would sell them "employment screening" at the touch of a button. </P><P>As you will see later, this can pose a big problem.Why do you need to know this simplified history? Simple ? not all companies evolve equally, and in order to understand whether or not you are going to get your pilot program of employment screening to fly, you need to know where the exposure for negligent hiring will rest in the scheme of things. Talk about inner conflict ? try to become thoroughly knowledgeable in either the security or human resources area, let alone both! These are two disciplines, which may rarely see eye to eye on anything. But you are going to have to know both equally well if you re charged with spearheading the drive to get your company's management to commit to a competent policy of factually screening employment candidates, regardless of your position. In this era of "political correctness" we are often reminded that, more often than not, something cannot be "right" or "wrong" because of the judgmental connotations those words convey. Employment screening is not immune to this distinction, but as well all know, facts are facts, and vent the best con artist can't dispute them. </P><P>This is why you must be thorough in conducting a background check.This article will not address drug testing, psychological testing referencing, or verification work, as these areas do not yet have as many legal implications surrounding them, and most employers have their own methods which are about as unique as fingerprints. However, the following recommendations are suggested for a comprehensive screening program.Three "Must Knows"You must know the person's true identity by obtaining positive candidate identification. Major recent studies have shown that as much as 20% to 30% of the population maintains undisclosed aliases or AKAs. This is critical, since checking a wrong name for criminal convictions will yield a "no record" response almost every time. There are many ways that an identity can be verified and cross-checked without breaking the law. </P><P>These are usually proprietary to the vendor, but can include social security number traces, driver's license number checks, address-telephone verifications, and a myriad of other attainable bits of research.You must grasp the person's responsibility attitudes. This is usually best determined by a person's payment attitudes (credit history and driving history. Beware! One argument that is encountered against running credit reports is that "minorities have it tougher." While studies do exist that set forth deficient societal and employment opportunities which plague certain groups, the fact is that if an employment candidate agrees to pay someone back after borrowing money from then, but doesn't, it doesn't matter what their color, race, sex, or persuasion is. That person defaulted, and they should have a good explanation as to why. Judge this explanation on the merits of the individual situation, not the argument that a certain class of people may be disadvantaged. </P><P>If they borrow, they should pay it back; if they can't, there's usually a good (or bad) reason why.As far as driving histories go, even if the person will not be driving a company vehicle, you till need to know the manner in which they drive and the manner in which they resolve issues that may arise while they are driving. These are nuts and bolts responsibility attitude indicators here ? nothing fancy, but good common sense, and very important if you want to make a good hiring decision.You must know the full extend of the subject's criminal history. This can only be done jurisdictionally, and you must see all levels, not just felonies. The courts today are downgrading many felonies in order to stop the logjam occurring everywhere in the higher courts, so if you don't research at the lower levels you may miss some eye-openers.Don't forget that people commit federal crimes, which do not appear in the local or state court indices. They have to be researched at the U.S. </P><P>District Court level. Most screening companies don't do this, and if they do, it's usually through databases of microfilm. Beware! You need a company that checks all levels, or the search is no good.Many times our company has been hired after an "$8.25 criminal check" failed and someone was subsequently murdered, raped, maimed or defrauded. In these instances, we sometimes not only perform employment screening from then on, but also testify as an expert witness against the firm who did the faulty job of screening. Beware of companies that offer a newspaper or police blotter clipping service in the form of "nationwide" criminal checks. </P><P>These firms do not cover all areas of the U.S., just the major metropolitan areas. Most important is the fact that the root company is many times resold through distributors who might not fully convey that the search, while touted as "nationwide," is actually limited to these more populated areas.Database ServicesLet's also take a moment to further address the growing industry called "database." It is very important to understand some basic things about database services that they will never tell you. Databases, no matter how good, are only as good as the search logic used to retrieve the data that's put in. That's the rub.
